INTRODUCTION

The website www.hopstore.fr (hereinafter referred to as the "Site") is an information and e-commerce site accessible via the Internet, open to any user of this network (hereinafter referred to as the "Internet user"). It is published by the company SAS HOPSTORE (hereinafter referred to as "HOSPTORE"), whose registered office is located at 57 chemin du Devant - 71250 Buffières, registered in the Macon Trade and Companies Register under number 851 200 667.

The Site enables HOPSTORE to offer organic hops for sale, in the form of cones, pellets, extracts, powders, etc. (hereinafter referred to as the "Products") to Internet users browsing the Site (hereinafter referred to as "Users"). The User having validated an order will be called "Customer". The rights and obligations of the User necessarily apply to the Customer.

Any order of a Product offered on the Site implies the consultation and express acceptance of these general terms and conditions of sale, manifested by ticking the box "I declare that I have read and accept the general terms and conditions of sale HOPSTORE ".

ARTICLE 1 - PURPOSE

The purpose of the present general terms and conditions of sale is to define, exclusively, by reason of the relations that they establish on the Internet network, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.

They shall regulate all the necessary steps for placing the order and shall ensure the follow-up of this order between the Parties.

These terms and conditions apply to the exclusion of all other documents.

ARTICLE 2 - PRODUCTS

2.1 Products

The Products offered for sale by HOPSTORE are those appearing on the Site, on the day the User consults the Site and within the limit of available stocks.

In the event of unavailability of one of the Products, the client will be informed as soon as possible.

Photographs and texts illustrating the Products do not fall within the scope of the contract.

2.2 Resale of products HOPSTORE

The resale of HOPSTORE products is not authorised unless there is a written and contractual agreement with the company SAS HOPSTORE which owns the brand.

The repackaging of products HOPSTORE for resale under another brand is not authorised without the written agreement of the company SAS HOPSTORE.

ARTICLE 3 - PRICES

The prices are indicated in Euros and are valid for the territories of the European Union except DOM and TOM. They take into account possible reductions as well as the French VAT, applicable on the day of the order.

Any order placed on the Site and delivered outside the European Union and the French Overseas Departments and Territories will be invoiced without VAT and may be subject to possible taxes, customs duties and other related costs that are imposed when the package reaches its destination. These additional costs are to be borne by the Customer and are the Customer's responsibility.

The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except in the case of obvious typographical error or omission.

The prices indicated do not take into account the shipping costs which will be invoiced in addition or offered depending on the amount of the order and the country of delivery, and will be specified to the User during the final validation of his order.

These shipping costs do not include customs and other ancillary costs that may be requested at the entry of certain countries, these costs remain the exclusive responsibility of the customer.

HOPSTORE reserves the right, which the User accepts, to modify its prices at any time.

ARTICLE 4 - ORDER REGISTRATION AND VALIDATION

4.1 Navigation within the Site

The User can take note of the various Products offered for sale by HOPSTORE on its Site.

The User may freely browse the different pages of the Site without being committed to an order.

4.2 Registering an order

If the User wishes to place an order, he/she will select the various Products in which he/she is interested, and express his/her interest by clicking on the " Add to cart " button.

At any time, the User may :

  • obtain a summary of the Products he or she has selected, by clicking on "Cart".
  • continue or modify your selection of Products by clicking on "Back to the shop".
  • complete its selection of Products and order these Products by clicking on "Place my order".

In order to order the Products he has chosen, after having clicked on "Place my order", every User must identify himself, by entering his e-mail address and the password he will have previously chosen when creating his account, or, if it is his first order, by clicking on "Create my account". In the latter case, the User must accurately fill in the form provided, on which he/she must include the information necessary for his/her identification and in particular his/her surname, first name and postal address. In addition, the User must provide his/her e-mail address and a password of his/her choice, which will be personal and confidential and which he/she will need to identify him/herself later on the Site.

The User is informed and accepts that the seizure of these two identifiers is proof of his or her identity and shows his or her consent.

Once the User is identified, he/she must validate the delivery address (as specified in article 5 below) and an order form will appear on the screen, summarising: the nature, quantity and price of the Products selected by the User, as well as the total amount of the order, the delivery costs, the User's contact details, and the billing and delivery address of the Products.

Commercial offers

To benefit from a commercial offer that has been sent to him, the User must enter and validate his "advantage code" in the field provided on the Order Summary page.

4.3 Final validation of the order and payment

After having read the status of his order, and once all the information requested has been completed by the User, a summary of this information and of the order will appear and the User will have to choose the method of payment with which he wishes to make his payment in order to definitively confirm his order.

Orders are payable in euros by French or international credit card.

It is specified that by making an immediate payment by credit card, the User will then be automatically transferred to the secure payment platform's electronic payment server. This platform is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all the data linked to the means of payment, and at no time will the User's banking data be transmitted onHOPSTORE's computer system.

As soon as he validates his payment, the order is registered. The User becomes a Customer. The order form will be recorded on the computer registers ofHOPSTORE and will be considered as proof of the contractual relations between the Parties.

4.4 Order confirmation

A summary of the order will be displayed once the order has been validated.

This confirmation will include all the elements constituting the contract between the Parties.

This order summary will also be emailed to the Customer within minutes of purchase.

The Customer will then have access to the follow-up of his "Order" by clicking on "My Account" and by identifying himself by his e-mail address and password.

4.5 Changing an order

The follow-up of orders placed is accessible from the "My Account" menu.

To modify an order, it is necessary to cancel the order, put it back in the basket and then correct it as desired before validating it.

Modifying or cancelling an order is only possible when its status is "Pending".

An order in "In progress" or "Completed" status can no longer be modified.

Any order received by the Customer is final. No retraction or return of Products is possible.

ARTICLE 5 - DELIVERY

5.1 Delivery times and methods

Your orders are processed as soon as possible.

Orders are prepared as soon as payment is received. Payment by credit card guarantees the speed of processing your order.

Delivery time in mainland France

Shipments are made within 48 hours of receipt of payment for your order, unless otherwise specified on the "Shopping Cart" page.

After delivery by our Shipping Department, your order is delivered in 2 to 3 days by Coliposte (colissimo suivi).

These times are in working days, excluding postal delivery problems.

Delivery time to the rest of the world

Your order will be delivered by COLIPOSTE or FEDEX (or any other operator chosen by HOPSTORE) depending on the country of destination. The countries delivered, shipping methods and delivery times are indicated on the Site by clicking here.

5.2 Delay / non-delivery

Loss of parcels in transit

Colissimo and FedEx are very reliable services. However, as with any shipment, there may be a delay in delivery or the package may go astray. In the case of a delivery delay of more than 7 days, the Customer must inform HOPSTORE who will transmit the information to the Post Office or Fedex to initiate an investigation. This investigation may last up to 21 days from its opening. If during this period, the parcel is found, it will be redirected immediately to the Customer's home (in the majority of cases). If, on the other hand, the parcel is not found at the end of the 21-day investigation period, Colissimo or FedEx will consider the parcel as lost. In this case, HOPSTORE will send the Customer a replacement package at his expense. If the lost product(s) are no longer available at this time, HOPSTORE will reimburse the Customer for the amount of these products.

Order cancellation

In the event of a delay in delivery of more than 7 days in relation to the planned delivery date, the Customer may cancel his order by contacting HOPSTORE by e-mail or telephone.

5.3 Anomalies

Any anomaly concerning the delivery (damage, open package, damaged package, broken products...) must be imperatively indicated on the delivery slip as "handwritten reserves", accompanied by the Customer's signature. The Customer must immediately report the anomaly to HOPSTORE by e-mail so that a claim can be made to Coliposte or FedEx.

HOPSTORE will return the replacement product(s) to the Customer, at the Customer's expense.

ARTICLE 6 - QUALITY ASSURANCE

The Customer benefits from a guarantee of quality on the products HOPSTORE.

If the defect is proven, HOSPTORE undertakes to exchange or reimburse the defective or non-conforming products as well as any return costs within fourteen (14) days.

ARTICLE 7 - DATA PROCESSING AND LIBERTIES

The personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders and for the establishment of invoices. This information is strictly confidential and is not transmitted to third parties.

In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL) under the registration number: 2160770 v 0 of March 09, 2018.

In accordance with article 34 of the law of 6 January 1978, the Customer has the right to access, modify, correct and delete data concerning you.

ARTICLE 8 - DISPUTES

This contract is subject to French law. HOPSTORE cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from the misuse of the products marketed.

In the event of difficulties in the application of this contract, the Customer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other counsel of his choice.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to explain his situation. In the event of a dispute, the Customer will first contact the company to obtain an amicable solution.

The Commercial Court of Macon is the only competent court, whatever the place of delivery and the method of payment accepted.

ARTICLE 9 - RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.221-18 of the Consumer Code, the Customer has a period of 14 days to exercise his right of withdrawal without having to justify his reasons. The starting point of the period is the day of receipt of the order by the Customer or by the third party designated by him. If the 14-day period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended until the first following working day.

To exercise his right of withdrawal, the Customer must notify HOPSTORE of his decision to withdraw before the expiry of the period by means of an unambiguous statement such as an e-mail specifying the following elements: name, address, telephone number, order number, reference, type of article, price and quantities.

 

ARTICLE 9 - RETURN AND REFUND

The Customer can return the article to the address HOPSTORE, 57 chemin du Devant, 71250 Buffières.
The costs of returning the products are to be borne by the Member.

The transport of the products thus returned is the responsibility of the Member.

In the event that the product, due to its nature (bulky and/or heavy or high-value), cannot be handled by the Post Office, the Customer may use the service of a carrier of his choice.

The refund will be made within 14 days following the date on which HOPSTORE has been informed by the Customer of his decision to withdraw. In any case, this refund cannot be made before HOPSTORE recovers the article(s) that the Customer has retracted or provides proof of the return of these articles.

The refund will be made according to the means of payment of the returned order, unless the Customer agrees with HOPSTORE to a different means.

Reimbursement shall not be made if the article concerned has suffered depreciation as a result of handling other than that necessary to establish its nature, characteristics or conformity.
